      EU proposes to restrict D4 and D5 under REACH XVII

      On 20 February 2017, European Commission notified World TradeOrganisation (WTO) of a Proposed restriction of octamethylcyclotetrasiloxane (D4) anddecamethylcyclopentasiloxane (D5) in cosmetic products that are washed off innormal conditions of use by Notification G/TBT/N/EU/456. It intends to set a limitof 0.1% for such cosmetic products. The draft is expected to be adopted in thesecond half of 2017.

      In Annex XVII to Regulation (EC) No 1907/2006, the following new entryis added:

      Restricted substance                              

      70. Octamethylcyclotetrasiloxane (D4) ,CASNo 556-67-2 ,EC No 209-136-7

      Decamethylcyclopentasiloxane(D5) ,CAS No 541-02-6 ,EC No 208-764-6                                                                                                                       
      Requirement

      1. Shall not be placed on the market in wash-off cosmetic products in aconcentration equal to or greater than 0.1% by weight of either substance,after [date – twenty four months after the entry into force of thisRegulation].   

      2. For the purposes of this entry, ‘wash-off cosmetic products’ meanscosmetic products as defined in Article 2(1)(a) of Regulation (EC) 1223/2009that, under normal conditions of use, are washed off with water afterapplication.”             

       

      The Agency's Risk Assessment Committee('RAC') concluded D4 meets the criteria in Annex XIII to REACH Regulation forthe identification of a persistent, bioaccumulative and toxic ('PBT') substanceand a vPvB substance and that D5 meets the criteria for the identification of avPvB substance. So the two substances can possibly give rise to environmentalhazards during the normal use of washed-off cosmetics.

      The restriction will take into force on the twentiethday following its publication on the Official Journal of the European Union. SSTreminds that businesses have a 24-month period for technical adjustment if itis finalised. n the marketplace.
